These Terms of Use ("Terms") are a binding agreement between you and Aisly Software and Solutions (OPC) Private Limited ("Aisly", "we", "us", "our") and govern your installation and use of Test Board - A Test Management app for monday.com (the "App"). By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
1. The App
Test Board is a test-management application that runs inside monday.com. It lets you create test cases, test sets, test cycles, and test runs, execute tests, record results, report bugs as monday board items, link tests to board items, view reporting dashboards, and optionally generate test-case suggestions using AI. Features may change over time as described in Section 11.
2. Eligibility and accounts
You may use the App only if you have a valid monday.com account and the authority to install and operate apps on the relevant account, board, or workspace. You are responsible for ensuring your use complies with your organization's policies and with monday.com's own terms. The App is intended for business and workplace use and is not directed to individuals under 16.
3. Relationship with monday.com
The App is a third-party application that operates on the monday.com platform. monday.com is not a party to these Terms and is not responsible for the App. Your use of monday.com is governed by monday.com's own terms and policies. The App is built and hosted on monday Code, and access depends on the monday.com platform and the OAuth permissions you grant at install.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your internal business purposes for as long as it is installed on your monday.com account. Your access to paid features and your plan entitlement are provided and managed through monday.com's subscription and billing system (see Section 9). We reserve all rights not expressly granted.
5. Acceptable use
You agree not to:
- Use the App in violation of any law, regulation, or third-party right.
- Reverse engineer, decompile, copy, resell, sublicense, or create derivative works of the App, except where permitted by law.
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the App, the monday.com platform, or related systems.
- Circumvent usage limits, security controls, rate limits, or access scoping.
- Upload or process unlawful, infringing, or malicious content through the App.
We may suspend or limit access to protect the App, our users, or third parties, or to comply with law.
6. Your content and responsibilities
You retain ownership of the content you create or input through the App, including test cases, steps, results, and any board data you associate with it ("Your Content"). You are solely responsible for Your Content and for the accuracy and lawfulness of the data you process. You grant us the limited rights necessary to host, process, and display Your Content in order to provide the App. You are responsible for maintaining appropriate backups; the App relies on monday.com's infrastructure for storage as described in our Privacy Policy.
7. AI features
The App offers optional AI test-case generation powered by OpenAI. When you use it, sanitized board and item text (no user identities) is sent to OpenAI to generate suggestions, as described in our Privacy Policy. AI output is generated automatically, may be inaccurate or incomplete, and is provided as suggestions only. You are responsible for reviewing, editing, and deciding whether to use any AI-generated content. We do not warrant the accuracy, quality, or fitness of AI output.
8. Third-party services
The App depends on third-party services, including monday.com and OpenAI. Those services are governed by their own terms and privacy policies, and we are not responsible for their availability, performance, or actions. Your use of the App through these platforms is subject to their requirements.
9. Fees, plans, and licensing
The App uses monday.com's pricing model. Plans, prices, free trials, upgrades, downgrades, billing, taxes, refunds, and payment processing are managed entirely by monday.com through its marketplace and billing system, and are subject to monday.com's terms. We do not separately bill you or store your payment details.
Your entitlement to paid features (your license and plan level) is determined and enforced by monday.com based on your active subscription for the App. If your monday.com subscription changes, lapses, or is cancelled, your access to paid features will change accordingly. Any billing questions, cancellations, or refund requests are handled through monday.com.
10. Privacy
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you acknowledge that information is handled as described there.
11. Changes to the App and Terms
We may add, modify, or discontinue features of the App at any time. We may also update these Terms from time to time; we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that it will meet your requirements. You use the App at your own risk.
13. Limitation of liability
To the maximum extent permitted by law, Aisly and its team will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, business, or goodwill, arising out of or related to your use of or inability to use the App. To the maximum extent permitted by law, our total aggregate liability arising out of or related to the App and these Terms will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or fifty US dollars (USD 50).
14. Indemnification
You agree to indemnify and hold harmless Aisly and its team from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the App, or your breach of these Terms or of applicable law.
15. Term and termination
These Terms apply for as long as the App is installed. You may stop using the App and uninstall it at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if the App is discontinued. Upon uninstall, your data is deleted as described in our Privacy Policy (permanently deleted within 7 days). Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
16. Governing law and jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, the courts located in Uttar Pradesh, India will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the App.
17. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
